In consideration for being allowed by the USBG National Charity Foundation (“USBG NCF), the United States Bartenders’ Guild and its chapters (“USBG”), Activity Sponsors ("Sponsors"), and respective parents, subsidiaries, advertising agencies, agents, affiliates, officers, and employees (collectively, the “Released Parties”) to participate in Team Happiness activities on or around [INSERT EVENT DATE], which may include but are not limited to, riding a bicycle or other self-propelled wheeled transportation on public and/or private property, riding a stationary bicycle or other similar equipment on public and/or private property, and/or participating in any Team Happiness related activities that do not include self-propelled wheeled transportation (hereinafter referred to as “Activity”), I, on behalf of myself and my assigns, heirs, and next of kin) collectively “I”, “Me”, or “Myself”):
 

1. Waiver of Claims: I waive and release all claims against the Released Parties for any injury, loss, or COVID-19 exposure arising from my participation in the Activity, including claims of negligence.

 

2. Indemnification: I agree to indemnify the Released Parties from any claims or costs resulting from my participation in the Activity, including attorney fees and damages.

 

3. Media Release: I consent to the use of my name, image, and statements by the Released Parties for promotional purposes without compensation.

 

4. Safety Gear: I will wear proper safety gear, including a helmet, while using self-propelled wheeled transportation, understanding failure to do so forfeits my participation rights.

 

5. No Alcohol: I will not consume alcohol before or during the self-propelled transportation portions of the Activity. Failure to comply forfeits my participation rights and registration fee.

6. COVID-19 Acknowledgment: I understand COVID-19 is a highly contagious virus and the risks of exposure, contracting, and spreading it, even from asymptomatic individuals.

 

7. Risks Acceptance: I acknowledge the Activity may result in injury, property damage, or COVID-19 exposure. I voluntarily accept all associated risks, participating as a volunteer, not as a work-related activity.

 

8. Compliance with Guidelines: I agree to follow all local, state, and federal laws, and Activity health and safety guidelines. Non-compliance may result in removal from the Activity without refund.

Choice of Law: This agreement is governed by Nevada law.

Severability: If any part of this agreement is invalid, the remaining provisions will remain in effect.

Health Certification: I certify I will not attend the Activity if, within 14 days prior, I experience COVID-19 symptoms, believe I have been exposed to COVID-19, or have been advised against interaction by health authorities.

I HAVE READ AND UNDERSTAND THIS WAIVER AND RELEASE, AND I VOLUNTARILY ASSUME THE RISKS AND WAIVE MY RIGHTS AS DESCRIBED ABOVE.

Health Guidelines
Do not participate in the Activity if:

* You have COVID-19 symptoms (fever, cough, shortness of breath, loss of smell, etc.) within 14 days before the Activity.

* You believe you have been exposed to COVID-19 or have been diagnosed with COVID-19 and are not cleared as non-contagious.

* Public health authorities advise against interacting with others based on your circumstances.
